Canadian Federal Budget 2026 – Carbon Pricing and Clean Electricity

On November 5, the Canadian  federal government tabled Budget 2026, Masters of Our Destiny. Most of its energy and climate content sits in Chapter 1, Canada's Investment Supercycle.

For carbon market participants, the budget is light on detail. It introduces no new carbon pricing measures and largely restates work already underway: an updated federal industrial carbon pricing benchmark and closer alignment between carbon markets across Canada. Two items carry more substance. The first is a proposed amendment to the Greenhouse Gas Pollution Pricing Act (GGPPA) that would retroactively remove the four-times penalty rate for late compliance under the federal Output-Based Pricing System (OBPS). The second is a signal that the Clean Electricity Regulations (CER) will let power producers offset more of their emissions with verified reductions from elsewhere in the economy.

Industrial Carbon Pricing Benchmark and Market Linkage

Under Advancing Canada's climate competitiveness, the budget sets out two carbon pricing commitments:

“Working to establish a predictable and effective carbon pricing system that supports emissions reductions while providing clarity for businesses and investors. As part of this effort, we intend to update the federal industrial carbon pricing benchmark to provide greater certainty for industrial emitters, clean technology developers, and capital markets, and to support continued investment in emissions reductions.”

“Collaborating with provinces and territories to explore opportunities for ensuring greater alignment and linkages between carbon markets across Canada, improving market efficiency, and helping achieve emissions reductions at lower cost.”

Both reaffirm processes already in motion. On the benchmark, Environment and Climate Change Canada (ECCC) has already set a new headline price trajectory and confirmed that it will form part of a full, updated federal benchmark to be published later in 2026. The budget adds nothing on the stringency criteria that will accompany the price, such as coverage, output-based standard tightening, offset quality and carbon leakage protections, which we continue to expect in the benchmark publication before year-end. The fiscal tables also confirm the federal OBPS remains in place, with proceeds averaging $14.3 million per year over the forecast horizon.

On linkage, First Ministers agreed in July 2026 to launch a federal–provincial–territorial working group to explore models for linking carbon markets across Canada. The group, with representatives from every province and territory plus Ottawa, held its first meeting the week of October 19 and discussed a draft workplan. It is expected to report detailed recommendations to First Ministers by July 2027, and runs separately from the benchmark review and broader GGPPA engagement. The budget language mirrors that mandate and does not bring the timeline forward.

Amendments to the Greenhouse Gas Pollution Pricing Act

One notable item sits in the budget's annex of legislative measures. The government proposes to amend the GGPPA to “retroactively remove the four-times ‘increased rate’ for late compensation and facilitate refunds for past increased rate payments and in cases of corrected emissions information.”

Part 2 of the GGPPA establishes the federal OBPS. Under the federal OBPS, a facility that misses the regular compliance deadline currently pays four times the normal rate on any shortfall. At the 2025 headline price of $95 per tonne, that means $380 per tonne for late compliance. The same four-times rate also applies to extra obligations that arise when a facility corrects its emissions report.

The increased rate has functioned as the program's main deadline enforcement tool. Removing it, retroactively, means a facility that misses the regular-rate deadline would compensate at the standard rate, and facilities that have already paid the increased rate would be eligible for refunds. The second element, facilitating refunds where emissions information is corrected, addresses facilities whose obligations fall after a verified report is revised, which the Act currently handles mainly through the issuance of surplus credits rather than cash refunds.

The budget does not say whether the increased rate will be replaced by another late-compliance mechanism, such as interest or a monetary penalty, or how far back the retroactivity reaches. The practical market impact is limited by the federal system's small footprint, but the change will matter to covered facilities with outstanding or past increased-rate obligations. Details will come with the implementing legislation.

Clean Electricity Regulations: A New Source of Offset Demand?

The budget confirms the government intends to update the CER, finalized in December 2024, to give electricity systems more flexibility while keeping the net-zero by 2050 goal. The proposed changes would:

“Allow existing electricity facilities to operate for longer, including where needed to maintain reliability.”

“Provide more certainty for planned investments in electricity generation, as well as more flexibility, including, for example, for natural gas in the near term, as well as hybrid energy systems and distributed renewables”

“Make emissions reductions more cost-effective by allowing electricity producers to offset more of their emissions through verified reductions elsewhere in the sector and economy.”
The third change is the most relevant for carbon markets. The CER already allows electricity units to cover part of their emissions with eligible offset credits, up to a set limit. The budget signals that this flexibility could expand, both in how much producers can offset and in where those reductions can come from.

Our read is that this could open the CER to a broader range of offsets and other emission reduction credits from carbon markets across Canada. That would create a new source of compliance demand for credits that today are used only within their own systems.

ClearBlue will continue to monitor the publication of the updated federal benchmark, the legislation implementing the GGPPA amendments and the CER consultation, and will incorporate them into our updated scenarios.
